Article 1 — Definitions
1. Mimar Nest: The private entity or sole proprietorship operating the online webshop, registered in the Netherlands with the Chamber of Commerce (*Kamer van Koophandel / KvK*).
2. Customer: Any natural person acting for purposes outside their trade, business, craft, or profession (Consumer), or any legal entity placing an order through the webshop.
3. Webshop: The website accessible via https://www.mimarnest.nl
4. Day: Calendar day.
5. Right of Withdrawal: The option for the Consumer to waive the distance contract within the statutory cooling-off period.

Article 3 — Applicability
1. These General Terms and Conditions apply to every offer made by Mimar Nest and to every distance contract concluded between Mimar Nest and the Customer.
2. Prior to the conclusion of the distance contract, the text of these General Terms and Conditions will be made available electronically to the Customer in such a way that it can be easily stored on a durable data carrier.
3. If specific product or service conditions apply in addition to these General Terms and Conditions, the Customer may always rely on the applicable provision that is most favorable to them in the event of conflicting conditions.
Article 4 — The Offer & Contract Formation
1. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
2. The offer contains a complete and accurate description of the offered products. Obvious errors or mistakes in the offer (such as clear typographical or pricing errors) are non-binding on Mimar Nest.
3. The contract is concluded at the moment the Customer accepts the offer, satisfies the conditions set out, and receives an electronic Order Confirmation from Mimar Nest.
Article 5 — Right of Withdrawal (Cooling-Off Period)
1. 14-Day Cooling-Off Period: When purchasing products, a Consumer has the right to dissolve the agreement without giving reasons within 14 days. This period commences on the day after the product is received by or on behalf of the Consumer.
2. Duties during the Cooling-Off Period: During this period, the Consumer shall handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to assess whether the Consumer wishes to keep it (similar to testing an item in a physical shop).
3. Exclusions from Withdrawal: The Right of Withdrawal does not apply to:
• Custom-made or personalized items.
• Sealed goods that are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery.
• Products that spoil or age rapidly.
Article 6 — Costs and Procedure for Returns
1. Exercising the Right: To exercise the Right of Withdrawal, the Consumer must inform Mimar Nest within 14 days of receipt via an unambiguous statement (e.g., email or model withdrawal form).
2. Return Period: The Consumer must return the product within 14 days after notifying Mimar Nest of their decision to withdraw.
3. Return Costs: The direct costs of returning the goods shall be borne by the Consumer, unless Mimar Nest has explicitly agreed to bear those costs or failed to inform the Consumer beforehand that they must bear them.
4. Refund: Mimar Nest will reimburse all payments received from the Consumer, including standard delivery costs, within 14 days from the day on which Mimar Nest is informed of the decision to withdraw. Mimar Nest may withhold reimbursement until the returned goods have been received or until proof of return is provided.
5. Diminished Value: The Consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Article 7 — Pricing & Payment
1. Prices displayed on the webshop are stated in Euros (€) and include statutory Dutch VAT (*Btw*), unless otherwise explicitly stated.
2. Prices exclude shipping costs, which are clearly shown before the final order placement.
3. Unless agreed otherwise, amounts owed by the Customer must be paid using the payment methods offered during checkout (e.g., iDEAL, Credit Card, Bancontact, Klarna).
4. Mimar Nest reserves the right to adjust prices at any time; however, price changes will not affect orders already confirmed in writing.
Article 8 — Delivery and Execution
1. Mimar Nest will take the greatest possible care when receiving and executing orders for products.
2. The place of delivery is the address provided by the Customer to Mimar Nest.
3. Deliveries will be carried out within 30 days of order confirmation, unless a longer delivery period was agreed upon. If delivery is delayed or an order cannot be executed in full, the Customer will be notified no later than 30 days after placing the order, in which case the Customer has the right to dissolve the contract free of charge.
4. Risk of Loss: The risk of damage to or loss of products rests with Mimar Nest until the moment of delivery to the Consumer or a pre-designated representative announced to Mimar Nest, unless explicitly agreed otherwise.
Article 9 — Conformity and Statutory Guarantee
1. Mimar Nest guarantees that the products comply with the contract, the specifications stated in the offer, and the reasonable requirements of soundness and/or usability under Dutch and European law.
2. Under Dutch consumer law, Consumers are entitled to a statutory guarantee (*wettelijke garantie*). If a product is defective or does not perform as reasonably expected, the Customer must report this to Mimar Nest within a reasonable time (typically within 2 months of discovering the defect).
3. If a defect is justified under statutory guarantee rules, Mimar Nest will arrange for repair, replacement, or a partial/full refund at no cost to the Customer.
Article 10 — Complaints Procedure
1. Mimar Nest maintains a sufficiently publicized complaints procedure and handles complaints in accordance with this procedure.
2. Complaints about the performance of the contract must be submitted fully and clearly described to Mimar Nest within a reasonable time after the Customer has discovered the defects.
3. Complaints submitted to Mimar Nest will be answered within 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, Mimar Nest will respond within 14 days with an acknowledgment of receipt and an indication of when the Customer can expect a more detailed answer.
4. If a complaint cannot be resolved amicably, Consumers may submit the dispute to the European Online Dispute Resolution (ODR) Platform at https://ec.europa.eu/consumers/odr.
Article 11 — Intellectual Property
1. All intellectual property rights (including copyrights, trademarks, design rights, and database rights) regarding the Mimar Nest webshop, design, text, photography, and branding belong exclusively to Mimar Nest or its licensors.
2. No content from the website may be copied, stored, or distributed without prior written permission from Mimar Nest.
Article 12 — Applicable Law & Jurisdiction
1. All legal relationships between Mimar Nest and the Customer shall be governed exclusively by Dutch law.
2. The applicability of the Vienna Sales Convention (CISG) is explicitly excluded.
3. Any disputes arising from or related to agreements between Mimar Nest and the Customer will be submitted to the competent court in the district where Mimar Nest is established, unless mandatory law designates another court. For Consumers, mandatory statutory jurisdiction rules regarding consumer residence apply.
